LAND SERVITUDES IN THE STATE LAND CADASTRE: ESSENCE AND INFORMATION REPRESENTATION

Abstract

The article examines the place and role of land easements in the system of the State Land Cadastre of Ukraine as one of the key legal mechanisms for regulating land relations. It is emphasized that the institution of easements has a long historical background and today serves as an important tool for balancing private and public interests in the field of land use. Particular attention is paid to the need for proper legal regulation and accurate representation of easements in cadastral data, which makes it possible to avoid conflicts between landowners and land users and ensures predictability in decision-making. The informational dimension of easement registration in the State Land Cadastre is analyzed in detail. It is underlined that easements are not only legal restrictions but also have spatial representation, as their establishment requires corresponding entries in the textual and graphical sections of cadastral records. The growing role of digital tools and services is highlighted, as they contribute to the openness of cadastral data, provide timely access to information, and create the foundation for further integration of Ukraine into the European spatial information infrastructure. The practical aspect of the study is demonstrated using the example of Malehiv village, Lviv district, Lviv region, where the establishment of a land easement is proposed to ensure the right of vehicle passage. The peculiarities of representing the boundaries of the easement in cadastral data and its significance for guaranteeing accessibility to a land parcel in communal ownership are discussed. This example confirms the importance of applying a comprehensive approach to the planning of easements, which combines both legal and informational aspects. Improvement of cadastral registration of easements in the current context is regarded as an integral part of the digital transformation of land relations. This will contribute to greater transparency in land management, increase the investment attractiveness of territorial communities, and ensure effective spatial development in the post-war period.
